U.S. ITC Votes to Advance Investigation into Unfair Trade Practices for Temporary Steel Fencing from China
[STATESVILLE, NORTH CAROLINA] – Today, the U.S. International Trade Commission (ITC) voted in the preliminary phase of its investigation into temporary steel fencing imports from China, determining that there is a reasonable indication that the domestic industry is materially injured or threatened with material injury due to unfair trade practices. As a result, the investigation will now proceed to full antidumping and countervailing duty investigations at the U.S. Department of Commerce, as well as a final phase injury investigation at the ITC.
The ITC’s decision follows a petition filed by ZND US Inc. (ZND), a leading domestic producer of temporary steel fencing, and supported by other producers collectively representing the majority of domestic production. The petition was filed in response to concerns over the surge of temporary steel fencing imports from China at prices that undercut fair market competition. The petition alleges that these imports benefit from unfair government subsidies and are being dumped into the U.S. market at artificially low prices, causing significant harm to domestic manufacturers.
This decision by the ITC is a critical step toward restoring fair competition in the temporary fencing industry. This investigation will help ensure that U.S. businesses can compete based on quality and innovation rather than distorted pricing practices.
The Commerce Department will now conduct in-depth investigations to determine the extent of dumping and subsidies. If Commerce finds that Chinese imports are indeed being unfairly traded, it could result in the imposition of duties to offset these unfair trade practices. Commerce initiated its investigations based on estimated dumping margins as high at 738.98 percent and 28 different subsidy programs that could be benefitting Chinese producers. The ITC will then conduct its final phase injury investigation before reaching a definitive determination.
Commerce’s preliminary subsidy determination is currently due in April and its preliminary dumping determination is due in June, though the deadlines can be extended. The final determinations in these cases are expected to take place in early 2026.
